Can't sell because of a title problem?

A title company won't insure a sale until the title is clean. ARCH Relief buys Minnesota properties with title problems, and we coordinate the curative work with licensed title companies and attorneys so the sale can close.

Title problems we see often

Does this sound like your situation?

  • A deed was signed but never recorded, or can't be found.
  • A break in the chain of title, where ownership skipped a step.
  • An old mortgage was paid off, but the release was never recorded.
  • Judgments or liens against a past or current owner.
  • A contract for deed that was never completed or recorded.
  • A deceased owner's interest was never transferred to the heirs.
Good to know

What "curative work" means

Fixing a title is called curative work. Depending on the problem, it can mean recording a missing document, getting an old lender to release a mortgage, settling or clearing a lien, or a court process to confirm who owns the property.

Most title problems can be fixed. They take time and know-how, and that's the part we coordinate.

This is general information, not legal advice. For advice about your situation, talk with a licensed Minnesota attorney.

Questions

Common questions.

Don't see your question? Call (763) 313-8891 and we'll talk it through.

What is a "break in the chain of title"?

The public record should show each owner passing the property to the next. When a step is missing, such as a deed that was never recorded or an inheritance that was never transferred, a title company won't insure the sale until it's fixed.

An old mortgage was paid off years ago. Why is it still a problem?

Sometimes the lender never recorded a release. The mortgage still shows up on the record even though it's paid. This can usually be fixed, even if the lender no longer exists.

Who pays to fix the title?

We do. When we buy the property, the curative work is coordinated and paid for by ARCH Relief. You have no out-of-pocket costs.

Are you attorneys?

No. ARCH Relief is a real estate company, not a law firm, and we don't give legal advice. We work alongside licensed Minnesota attorneys and title companies.
